Terms of Service

1. Introduction

Welcome to VisaSettle (the “Platform”), operated by VisaSettle (“VisaSettle,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the VisaSettle website, application, and related services (collectively, the “Services”).

By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

2. Eligibility

You must be at least 18 years old to use the Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.

You are responsible for ensuring that any information, documents, or materials you provide through the Services are accurate, complete, and up to date.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access or use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account.

4. Subscriptions & Billing

4.1 Free Tier

We offer a Free tier with limited features as described on our Pricing page. We reserve the right to modify the features available in the Free tier at any time.

4.2 Premium Subscription

Premium subscriptions are billed monthly (or annually, if selected) in advance. Fees are non-refundable except as expressly stated in these Terms or as required by applicable Australian consumer law. We may change our subscription fees upon 30 days' notice.

4.3 Cancellation

You may cancel your Premium subscription at any time. Cancellation takes effect at the end of your current billing period. No pro-rata refunds will be provided for partial billing periods.

5. Acceptable Use

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
• Upload, store, or share any content that infringes upon the intellectual property rights of others;
• Upload or transmit any viruses, malware, or other harmful code;
• Attempt to gain unauthorised access to any part of the Services, other user accounts, or our systems;
• Use the Services to store or process sensitive personal information beyond what is reasonably necessary for visa application management;
• Interfere with or disrupt the integrity or performance of the Services.

6. User Content

You retain all ownership rights to the documents, files, and other content you access, organise, or manage through the Platform (“User Content”).

Where you choose to connect a Google Drive account, your documents remain stored within your own Google Drive environment. VisaSettle does not generally host, store, or maintain copies of your original documents on its own servers. We may access, process, and display information related to your User Content solely for the purpose of providing the Services, including document organisation, reminders, file categorisation, and other platform functionality.

You represent and warrant that your User Content does not violate any law or infringe upon the rights of any third party. You remain responsible for maintaining access to and backup copies of any documents stored within your Google Drive account.

7. Third-Party Integrations

The Services may integrate with third-party platforms such as Google Drive, Google Docs, and Google Calendar (“Third-Party Services”). Your use of Third-Party Services is governed by their respective terms and privacy policies. We are not responsible for the availability, accuracy, or security of any Third-Party Service.

8. Intellectual Property

The VisaSettle name, logo, website design, and all related software, trademarks, and intellectual property are owned by VisaSettle. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

9. Privacy

Your privacy is important to us. Our Privacy Policy and Cookie Policy explain how we collect, use, and protect your personal information. By using the Services, you consent to the practices described in those policies.

10. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or reliability.

VisaSettle is a document organisation and visa preparation platform designed to help users manage documents, track requirements, and organise visa-related information. VisaSettle does not provide migration advice, immigration advice, legal advice, or visa application services.

Any information, reminders, checklists, recommendations, templates, or AI-generated content provided through the Services are for informational and organisational purposes only. Such content may be inaccurate, incomplete, outdated, or unsuitable for your specific circumstances and should not be relied upon as professional advice.

VisaSettle does not guarantee the approval of any visa application, compliance with immigration requirements, the accuracy of government information, or any particular immigration outcome. All visa decisions are made solely by the relevant government authority.

Where users connect third-party services such as Google Drive, Google Docs, Google Calendar, or other external platforms, VisaSettle does not control and is not responsible for the availability, security, performance, or reliability of those services.

VisaSettle does not generally store users’ original visa documents on its own servers. Users are responsible for maintaining access to, and backup copies of, any documents stored within their own Google Drive or other third-party storage services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, VisaSettle and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Services.

Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you have paid to us in the 12 months preceding the event giving rise to the liability.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Australian consumer law, including the Consumer Guarantees under the Competition and Consumer Act 2010 (Cth).

VisaSettle shall not be liable for any loss, corruption, deletion, unavailability, or unauthorised access to documents stored within third-party services, including Google Drive.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, upon written notice. Upon termination, your right to use the Services will immediately cease. You may terminate your account at any time by contacting us. Sections 8, 10, 11, and 14 shall survive any termination.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Platform. Your continued use of the Services after the effective date of the changes constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
